Question about DSGV-compliant cookie banner settings

Dear NicePage Support Team,

I hope you are doing well.

I have a question regarding the configuration of the cookie banner in NicePage. I would like to make sure it is fully GDPR-compliant — meaning that only the essential (necessary) cookies are pre-selected by default, while all other categories (e.g., marketing, statistics, external media) remain unchecked until the user gives consent.

However, I haven’t found a way to configure the cookie banner in NicePage to behave this way. Could you please let me know if this is currently possible, and if so, how to set it up correctly?

Thanks for choosing Nicepage!

You can add the Cookie Preferences Element to your Cookies Popup. It will allow your visitors to select the needed cookie types, which are more preferable for them.

I'm also interested in this topic. If I put Google Analytics or Tag Manager in the dedicated section of Nicepage, and use your cookies banner, will the cookies banner work and block cookies, or do I need to add some Java/PHP/other code? I mean, is it enough to just enable the cookies banner, or do I need to do something specific programmatically?

Hi, info1836,

There is no need to additionally adjust our Cookies Popup. It is enough to activate it in the site settings, and it will be ready to use. If needed, you can customize its layout, but the functionality of the Cookies Popup works right after enabling it and publishing the site.

thank you for your previous response.

Unfortunately, the issue remains unresolved. In Nicepage, it is currently not possible to configure the cookie banner so that only strictly necessary cookies are enabled by default. At the moment, all cookie categories (including statistics, marketing, and external media) are pre-selected, and there is no option in the UI to change this behavior.

I have also reviewed the available documentation and YouTube tutorials, but no solution or workaround addressing this specific issue could be found.

From a legal perspective, this is a significant problem.
Under German data protection law (GDPR in combination with TTDSG), the following applies clearly:

Only strictly necessary cookies may be enabled by default

All other cookies (e.g. statistics, marketing, external media) must be disabled by default

These optional cookies must be actively and explicitly selected by the end user (opt-in)

Pre-checked checkboxes for non-essential cookies are not permitted

This requirement has been confirmed by multiple court rulings and data protection authorities in Germany.

At the moment, the built-in Nicepage cookie banner appears to follow an opt-out approach, which does not meet these legal requirements.

Could you please clarify:

Whether it is currently possible to configure the cookie banner so that only necessary cookies are pre-selected, and if so, how?

If not, is this functionality planned for a future update?

We understand your concerns. At the moment, there is no option to define the pre-selected cookie options, but we have added this feature to our wishlist and hope it will be implemented in the future.

As a temporary solution, you can search for a third-party GDPR-compliant Cookies Popup. Our editor allows embedding such functionality by adding a custom script in the site settings.
